Description

This Deep Dive will cover the evolution of renewable energy development projects seeking IRA tax credits. We will utilize situational case examples to illustrate key considerations, risks and practical barriers to IRA prevailing wage and apprenticeships (PWA) compliance in the areas of contracting, recordkeeping and reporting, third-party interest (from investors and insurers) and overall wage compliance. Speakers will include developers, EPCs, and third-party consultants who are helping developers and EPCs navigate PWA provisions.

Examples of cases to be discussed include:

  • Failure to flow down IRA PWA or specify records access requirements in contracts with EPCs or subs
  • Failure to understand the level of information that will be required by tax equity investors, lenders, insurance companies and other interested third-parties
  • Inadequate cost segregation reviews leading to confusion on eligibility
  • Confusion over applicable wage tables due to start of construction and contract modification dates
  • Curing poor/unavailable records issues
